This Code of Ethics exists to safeguard the reputation and trustworthiness of ARBITAC and the Associação Comercial do Paraná (ACP, Parana Chamber of Commerce). All members who participate on the Board of Directors, in the ARBITAC Coordination Group, all ACP interns and employees assigned to perform roles at ARBITAC and any other people who in some manner or another participate in ARBITAC – hereafter to be termed "MEMBERS" – must be constantly conscious of the importance of exemplary ethical conduct, based on the following principles: The MEMBERS of ARBITAC must protect the reputation of ARBITAC and of the cases that it administers or prosecutes, being and remaining impartial, diligent and independent and courteous towards the parties and their counsel. Considering that Confidentiality is one of the fundamental characteristics of arbitration and mediation and considering that this may be the decisive factor in choosing ARBITACto administrate arbitration or mediation, ARBITACMEMBERS must undertake to maintain the most absolute Confidentiality with respect to arbitrations and mediations of which they have knowledge, however superficial that knowledge may be. This Confidentiality must be maintained even if the MEMBER leaves ARBITAC. The MEMBERS of ARBITAC must be constantly conscious that they are prohibited from accepting gifts or souvenirs from the parties, their counsel or any other persons who could be – or come to be - involved in arbitrations or mediations administrated by ARBITAC. With respect of the fees for arbitration or mediation proceedings, the MEMBERS must also be conscious that only the ARBITAC Secretariat may receive said fees, and MEMBERS are prohibited from receiving any sum whatsoever from the parties or their counsel, for whatever reason under any circumstances whatsoever. The MEMBERS of ARBITAC must strive to uphold the name of the Institution and must bear themselves with absolute transparency and loyalty, being prohibited from using ARBITAC as an instrument for their own or for others’ advancement. With a view to avoiding any possible conflict of interest that could compromise the observance of any of the standards of conduct described in this Code of Ethics, ARBITAC MEMBERS must request temporary suspension from their posts, until the impediment no longer exists.
